Data Log Files:

Our web server log files record data like IP addresses, browser types, internet service providers, referring and exit pages, platform types, and date/time stamps. We automatically collect analytics data when you use our Website, mobile apps, or widgets. This includes device information, network details, and interaction events. This pseudonymous data does not include personally identifiable information and is used to improve our services. We may use internal analytics and third-party providers for this purpose. For more details, refer to the "Analytics Providers" section.

Data from Third Parties:

When you sign in using your social media credentials (e.g., Facebook, Twitter, Google), the service sends us your username and associated email address. We do not control how these third parties manage or process your personal data.

How We Use Personal Information:

Definition of Legitimate Interests:

"Legitimate interests" refers to TRADEMAN’s and its affiliated businesses' interests in conducting and managing our business. When processing personal data for legitimate interests, we carefully consider and balance the potential impact on you and your rights under data protection laws. These interests do not automatically override your rights, and we do not engage in activities that may negatively impact you unless required or permitted by law or with your explicit consent. You have the right to object to the processing of your personal data based on legitimate interests at any time, particularly if it impacts your situation (see the "User Rights" section for more details).

  • Google Analytics: For web analytics on our Website, mobile apps, and widgets. For more information on these services and their data practices, please refer to their respective privacy policies.

If TRADEMAN sells its business or if company assets are acquired by a third party, your personal data, including account and subscription information, may be part of the transferred assets.

  • Protect Against Loss or Damage: This includes sharing information with law enforcement agencies, courts, or other authorities when necessary.

Advertising:

We display advertising on our Website and use remarketing and tracking features to show targeted ads based on your activity. These features also help us analyze ad performance. We collect pseudonymous data for these purposes and use services like:

  • Google Ad Manager and Google Ads: To serve and measure ads. For more information, see Google’s Privacy Policy. You can opt out via the Network Advertising Initiative opt-out page or by adjusting settings on Google Ad Settings.

Google reCAPTCHA:

We use Google reCAPTCHA to determine if data entered on our site is by a human or an automated program. This service helps protect against spam, fraud, and abuse by analyzing visitor behavior (e.g., IP address, visit duration, mouse clicks) as soon as they access the website. This analysis occurs in the background without informing the visitor and the collected data is forwarded to Google. More information on Google reCAPTCHA and their privacy practices can be found in Google’s Privacy Policy and What is reCAPTCHA?.

YouTube API Services:

We use the YouTube API to allow users to share selected video ideas to their YouTube account. To use this service, users must sign in with their Google account and grant us permission to upload videos to their YouTube account. We do not store, modify, delete, or view any other data from the YouTube account, nor do we share Google account information with third parties. Access to the YouTube account can be revoked at any time via the Google Security Settings page. By using this service, users agree to be bound by the YouTube Terms of Service.

Public Information on Our Site:

Public Profile:

When you create a profile on our service, other users or visitors can access your public profile and view any information you’ve made available. This includes market information (e.g., published ideas and scripts, market allocations, top mentioned symbols), social information (e.g., followers and following lists, ideas you follow and comment on), contact information (e.g., About section, avatar, links to social media accounts), and community status (e.g., Moderator or views, likes, followers, registration date, last visit date). Your email address will remain private.

Public Content:

Registered users can share charts, ideas, addon scripts, and other content publicly via our publish features. By publishing content, you grant us an irrevocable, perpetual, and royalty-free license to display the content and your username.

When commenting on content, we publish certain details about your comment, such as the date, time, profile link and avatar.

Chats and Private Messages:

When you engage in communication with other users through public or private chats, we store and process these messages along with any associated information. We scan links to ensure there is no malicious software or content and to detect spam and prohibited images/text. Even if you delete your private messages from your account, keep in mind that recipients still have a copy of your correspondence, which they can copy, store, or reshare. Always be vigilant about this possibility.

Security of Personal Data:

We prioritize the protection of your personal data using both technical and organizational safeguards, and we require third parties we work with to uphold the same standards. We use Transport Layer Security (TLS) encryption technology to protect certain information you submit to us, ensuring that it cannot be intercepted during transmission to TRADEMAN or payment processors. When you are on a secure page, such as our order form, a "lock" icon in your browser window will confirm that a secure, encrypted connection has been established.

We take several steps to ensure the security of our service and to meet industry standards, including the use of firewalls, authentication systems (e.g., passwords, personal identification numbers), and access control mechanisms to prevent unauthorized access to systems and data. If you have created an account, you are responsible for keeping your access details secret and not sharing them with anyone else.

We also take measures to protect user information offline. Access to personal information is restricted to employees who need it to perform their jobs, and the servers storing personal data are located in secure, locked facilities. We continually improve our security measures, including adding physical security measures to prevent unauthorized access to our systems. However, no method of electronic transmission or storage is entirely secure, so we cannot guarantee absolute security.

Children and Sensitive Personal Data:

This Website is not intended for children under the age of 18. We do not knowingly contact or collect personal information from children under 18 years old, nor do we collect sensitive personal data, such as racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data, health information, or data concerning a natural person’s sex life or sexual orientation. For more information on sensitive personal data, please refer to Article 9 of the GDPR. If you believe we have inadvertently collected such information, please contact us immediately so that we can either obtain special consent or delete the information.

Third-Party Sites:

At our discretion, we may include links to other websites on our Website. These third-party websites operate under separate and independent privacy policies. We do not hold any responsibility or liability for the content, activities, or privacy practices of these linked sites. We strongly encourage you to review the privacy policy of each site you visit.

EEA and UK Users' Specific Rights:

Individuals in the European Economic Area (EEA) and the United Kingdom (UK) are granted specific data subject rights under data protection laws, which pertain to the personal data we hold about them. These rights may be subject to limitations and/or restrictions.

If you are located in the EEA or UK, please contact us to exercise your rights.

Accessing Data:

If requested, we will confirm whether or not we are processing your personal data. If we are processing your data, we will provide you with a copy of that data along with relevant details. If you need additional copies, we may charge a reasonable fee depending on the situation, which can be discussed.

Restricting the Processing of Personal Data:

You have the right to ask us to restrict or ‘block’ the processing of your personal data in certain circumstances, such as when you contest the accuracy of the data or object to our processing of it. We will notify you before lifting any restriction on processing. If we share your personal data with others, we will inform them of the restriction where possible. If requested, and if it is feasible and lawful, we will also inform you with whom we have shared or will share your personal data so that you can contact them directly.

Objections:

  • You may ask us to stop processing your personal data at any time, and we will comply unless we can demonstrate compelling legitimate grounds for the processing.
  • You can object to our processing of your data for direct marketing purposes at any time by clicking the "unsubscribe" button in our marketing emails.
  • You can also refuse to receive service notifications via email (such as when a user you are subscribed to publishes a chart or idea) by adjusting your User Settings.

If we rely on your consent to process your personal data, you have the right to withdraw that consent at any time. This withdrawal will not affect the lawfulness of the processing conducted before the withdrawal was requested. However, we typically do not rely on your consent as the sole basis for processing your data if another lawful ground is available. If your consent is required, we will clearly communicate this to you at that time.

Viewing and Correcting Data:

You have the right to have any inaccurate personal data rectified or completed if it is incomplete. Users can view, manage, and update their personal data in their Profile Settings.

If we share your personal data with others, we will notify them of any corrections made whenever possible. Upon request, and where feasible and lawful, we will also inform you with whom we have shared your data so you can contact them directly if necessary.

Please refer to the "User Account Deleting" section for more details.

Data Retention:

We will retain your personal data (1) until you request the deletion of your account, or (2) as required by law or necessary for legitimate business purposes (e.g., for tax, legal, accounting, fraud, or abuse prevention, and other purposes). Data may be stored even after an account is deleted.

Upon the expiration of the applicable retention period, we will securely destroy your personal data in accordance with applicable laws and regulations. In some cases, we may anonymize your personal data, meaning it can no longer be associated with you. In such cases, this data is no longer considered personal.

If you have consented to receive marketing communications, we will retain your data until you unsubscribe, which can be done via the ‘unsubscribe’ button at the end of our marketing emails. Additional unsubscribe methods may be provided in the future.

Data Portability:

You have the right to obtain your personal data from us, which you consented to give or that was provided as necessary in connection with our contract with you. We will supply your personal data in a structured, commonly used, and machine-readable format, allowing you to reuse it elsewhere if desired.

Lodging a Complaint with the Data Protection Authority:

If you have concerns about our privacy practices, including how we handle your personal data, you can report them to any competent data protection authority within a European Union member state authorized to address such concerns. Contact information for European Union Data Protection Authorities can be found here. In the UK, you can contact the Information Commissioner's Office (ICO), the supervisory authority for data protection issues. If you wish to exercise any of these rights, please contact us. Note that we may need to verify your identity before responding to your request.

Please note that these countries may not offer the same legal standards for the protection of your personal data as the EEA. However, when transferring your data to countries outside your jurisdiction, we will take the necessary steps to ensure that your information receives adequate security protection and that your rights are upheld.

If you would like more information on the safeguards we implement, please contact us.

California Users' Specific Rights:

If you are an eligible California resident, the California Consumer Privacy Act (CCPA) grants you specific rights concerning our collection and use of your personal information. Under the CCPA, you have the following rights:

Right to Request Information:

You have the right to request that we disclose certain information to you regarding our collection and use of your personal information over the past 12 months. The list of categories of personal information collected and disclosed about consumers can be found in the section titled "Personal data that we collect." The list of categories of third parties to whom the personal information may be disclosed is detailed in the section titled "When would we share personal information." Please contact us to exercise a data portability request. Additionally, we do not sell your personal information.

Right to Request Deletion:

You have the right to request that we delete personal information we have collected from you. For more information on this process, please refer to the “User account deleting” section.

Right Against Discrimination:

You have the right not to be discriminated against concerning pricing and services when exercising any of your rights under the CCPA. We do not offer consumers financial incentives, price differentials, or services in exchange for selling a consumer's personal information.

If you have any questions or suggestions regarding the processing of personal data, please reach out to us using the provided form or contact us by email.
